INFORMATION PROVIDED IN ACCORDANCE WITH ARTICLES 13 AND 14 OF EU REGULATION 2016/679 – GDPR

  1. Source of Personal Data
    The personal data processed by AGOFSTORE SRL are collected directly from the data subject or from the offices of AGOFSTORE SRL.
  2. Data Controller
    The data controller is AGOFSTORE SRL, with its registered office at P.le Attilio Valgoi 9, 23100 SONDRIO (SO).
  3. Purposes of Data Processing
    Personal data are processed as part of the normal activities of issuing and managing payments and collections (in addition to related and instrumental activities) and for the following purposes:
    1. Purposes strictly related and instrumental to the management of relationships with the data subject (e.g., acquisition of preliminary information before the conclusion of contracts, execution of operations based on obligations arising from the contract concluded with the data subject, etc.);
    2. Purposes related to obligations arising from laws, regulations, and EU legislation, as well as provisions issued by authorities authorized by law and by supervisory and control bodies; The use of automated decision-making processes, including profiling under Article 22 of the GDPR, is not envisaged.

  5. Recipients of Personal Data – Communication
    1. For the performance of some of its activities, AGOFSTORE SRL also relies on external subjects. For this purpose, the personal data of the data subject may be communicated to the categories of subjects indicated below:
      Subjects involved in carrying out processes necessary for the execution of relationships with the data subject;
    2. Subjects involved in controlling and optimizing AGOFSTORE SRL’s activities (e.g., audit firms and consultants), for financial risk and fraud control, or for debt recovery.
      The subjects performing the types of activities mentioned above, to whom the data may be communicated, will use the data as „processors“ under Article 28 of the GDPR. The methods aimed at ensuring the confidentiality of personal data naturally remain in place. A list of these subjects is available at the headquarters of AGOFSTORE SRL.
    3. to respond to and satisfy every customer request and for any technical-organizational communications;
    4. for the organization and conduct of events and promotional activities;
    5. for sending informative or promotional communications, including commercial materials and/or offers and services by mail, fax, internet, telephone, email, SMS from AGOFSTORE SRL or from physical and/or legal entities collaborating in AGOFSTORE SRL’s commercial activities and/or from parent, subsidiary, or affiliated companies;
    6. for marketing purposes when the user has expressed specific and free consent (Art. 7 GDPR).
  6. Disclosure of Personal Data
    Personal data are not subject to disclosure.
  7. Categories of Processed Data
    The data processed by AGOFSTORE SRL are personal (personal, tax, communication, and contact data).
  8. Transfer of Data to a Third Country
    The data processed for the purposes mentioned above may be transferred to other countries belonging to the European Union.
  9. Data Retention Period
    The data processed will be kept for the minimum period necessary to achieve the purposes mentioned above. In particular, data with tax relevance will be kept for the time provided for by current national legislation (currently, 10 years). At the end of this period, the data will be anonymized or deleted, if technically possible.
  10. Legality, Nature of Data Provision, and Consequences of Any Refusal
    The provision of data is a contractual obligation and is essential to pursue the purposes of processing as indicated in points III A) B) C). Failure to provide the data would indeed make it impossible to fulfill the obligations arising from the contract, as well as from legislative provisions. Processing, pursuant to Article 6 of the GDPR, is aimed at fulfilling a contract to which the data subject is a party or at fulfilling pre-contractual measures taken at the request of the data subject or at fulfilling pre-contractual measures taken at the request of the same; to comply with a legal obligation to which the data controller is subject. The provision of personal data is optional for the purposes of points III D) E) and F), and the refusal to consent has no consequences.
  11. Data Processing Methods
    In relation to the indicated purposes, the processing of personal data, in compliance with the law and confidentiality obligations, is carried out through manual, computer, and telematic processing, with logic strictly related to the purposes themselves, and in any case in such a way as to ensure the security and confidentiality of the data (even in the case of the use of remote communication techniques).
  12. Data Subject Rights
    Data subjects have the right at any time to exercise their rights provided for by the GDPR in Articles 15 (access), 16 (rectification), 17 (erasure), 18 (restriction), 19 (notification obligation), 20 (portability), 21 (objection), and 22 (automated decision-making), by contacting the Data Controller directly.
